By accessing and using Omyguide, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Service Description

Omyguide provides downloadable digital travel guides in HTML format. The guides contain tourist information, place recommendations, and links to third-party services such as Google Maps.

3. Limitation of Liability

Omyguide is NOT responsible for: • The accuracy, timeliness, or completeness of information contained in the guides • Changes in schedules, prices, availability, or closure of mentioned establishments • The quality, safety, or experience at recommended places • External links to Google Maps, third-party websites, or any external content • Damages, losses, injuries, or any type of harm derived from using our guides • Decisions made by users based on guide information • Technical problems, errors, or service interruptions

4. Guide Content

The guides contain information collected from various public sources. Omyguide: • Does NOT independently verify all information contained in the guides • Does NOT guarantee the accuracy of schedules, prices, addresses, or contacts • Is NOT responsible for changes made by third parties after publication • Recommends verifying critical information directly with establishments

5. Third-Party Links

Our guides include links to third-party services such as Google Maps and external websites. Omyguide: • Does NOT control or take responsibility for the content of external sites • Does NOT guarantee the availability or accuracy of external links • Does NOT assume responsibility for damages derived from using third-party services • Links are provided solely for user convenience

6. Service Use

By using Omyguide, you agree to: • Use the guides for personal, non-commercial use only • NOT share, resell, or distribute the guides without authorization • NOT copy, reproduce, or extract content from the guides • Respect Omyguide's intellectual property rights

7. Intellectual Property

All Omyguide content (texts, design, structure) is protected by copyright. Reproduction, distribution, or commercial use without express authorization is prohibited.

8. Right of Withdrawal and Satisfaction Guarantee

In accordance with Article 103.m) of Spanish Royal Legislative Decree 1/2007 and EU Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium when performance has begun with the consumer's prior express consent. However, Omyguide voluntarily offers a Satisfaction Guarantee that goes beyond legal obligations: if you are not satisfied with your purchase, you may request a full refund within the first 2 hours of purchase. Only one refund per guide per user is allowed. This guarantee can be exercised directly from the "My Guides" section of the application, with no justification required.

9. Refund Policy

Omyguide offers a satisfaction guarantee under the following conditions: • Timeframe: 2 hours from the moment of purchase. • Limit: Only one refund per guide per user is allowed. • Process: The refund is requested directly from "My Guides" in the application. The process is automatic and immediate. • Amount: 100% of the price paid is refunded. • Method: The refund is processed through Stripe to the same original payment method. Depending on your bank, it may take 5 to 10 business days to appear. • Access: Once the refund is processed, access to the guide is immediately revoked. After the guarantee period, no refunds will be issued except in cases of demonstrable technical error preventing access to the purchased content. For any issues, contact info@omyguide.guide.

10. Applicable Legislation

Omyguide complies with: • Spanish Royal Legislative Decree 1/2007 (General Consumer Law) • Spanish Law 34/2002 on Information Society Services (LSSI-CE) • EU Directive 2011/83/EU on consumer rights • Regulation (EU) 2016/679 (GDPR)

12. Modifications

Omyguide reserves the right to modify these terms at any time. Changes will take effect immediately upon publication. Substantial changes will be notified by email.

13. Jurisdiction

These terms are governed by the laws of Spain. For consumers resident in the EU, the courts of the consumer's place of residence shall have jurisdiction. For other cases, Spanish courts shall have jurisdiction.
